Terms of Service

1. Acceptance of Terms

By accessing or using FragDraft ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

FragDraft is a free-to-play, skill-based esports prediction and progression game for Counter-Strike 2 tournaments. Outcomes depend entirely on the user's prediction accuracy and strategic choices. There are no chance-based mechanics, no wagering, and no cash prizes. Users can:

• Construct rosters of professional players under a fixed energy budget
• Deploy deterministic performance modifiers ("boosters") before matches
• Earn points based on real tournament performance
• Compete on global, per-tournament, and per-series leaderboards
• Progress through levels, titles, achievements, and cosmetic unlocks
• Optionally subscribe to FragDraft Pro or purchase a Season Pass (see §6)

3. Eligibility

• You must be at least 16 years old to use this Service
• You must provide accurate and complete registration information, including a valid date of birth
• The Service is not available in jurisdictions where fantasy-style skill games are restricted. Registration is blocked in the US states of Washington, Idaho, Montana, Nevada, Hawaii, Louisiana, and Arizona, and in other jurisdictions as required by applicable law
• You may not use the Service if you have previously been banned or if you are on a sanctions list

4. User Accounts

4.1 Account Creation

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities under your account
• Notify us immediately of unauthorized account access
• One account per person; multi-accounting is prohibited

4.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Service. Where a terminated account held an active subscription, §6.4 (Refunds) applies.

5. Gameplay Rules

• Energy Budget: Each draft has a fixed energy budget for player selection
• Draft Lock: Drafts lock when tournaments begin; no changes after lock
• Scoring: Points are awarded based on real player performance (kills, deaths, assists, round impact, etc.)
• Boosters: Deterministic performance modifiers from a known pool. Effects are disclosed at the point of deployment, are non-transferable, and have no cash-equivalent resale value
• Shards: An in-game currency earned through gameplay. Shards are not purchasable with real money under any circumstance and have no cash-equivalent value
• Fair Play: Exploitation of bugs, cheating, scripting, or any form of automation will result in disqualification and possible account termination

6. Paid Subscriptions & Season Pass

6.1 FragDraft Pro (Monthly Subscription)

FragDraft Pro is an optional recurring subscription (€9.99/month). Purchase grants access to the following defined bundle of benefits for the subscription period:

• 1.5× XP earning rate on gameplay actions
• Extended analytics dashboards (player, team, personal stats)
• Private leaderboards (create or join friend groups)
• Subscriber cosmetic pool (avatar borders, calling card backgrounds)
• One included Season Pass per season while subscribed
• One complimentary booster pack per month

FragDraft Pro auto-renews monthly until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.

6.2 Season Pass

The Season Pass is an optional, time-limited seasonal bundle (€9.99/season). Purchase grants access to a predetermined 50-tier reward track. Tiers unlock as you earn XP through play. Rewards are disclosed before purchase and consist of cosmetic borders, backgrounds, seasonal titles and badges, in-game booster packs, and XP multipliers. The Season Pass does not contain in-game currency, third-party digital items, or randomized rewards.

6.3 Payment & Billing

• All prices are listed in euros and are exclusive of applicable taxes unless stated otherwise
• Payments are processed by our third-party payment processor. You agree to the processor's terms at the point of checkout
• You must be 18 or older and the lawful cardholder to purchase
• We do not store full payment card details

6.4 Refunds

Refund eligibility is governed by our Refund Policy, which forms part of these Terms and is linked at checkout.

7. Rewards & Progression

7.1 In-Game Progression

Gameplay rewards consist of XP, levels, titles, badges, cosmetic unlocks, and in-game shards. These items exist only within the Service, are non-transferable, have no cash-equivalent value, and cannot be withdrawn, sold, or converted to money.

7.2 Referral Program

The referral program is a behaviour-based loyalty program open to all registered users regardless of subscription status. Eligibility and rewards are determined solely by the number of active referrals (a referral becomes active when the referred user completes their first tournament draft). Paid SKUs do not multiply, accelerate, or confer preferential eligibility for referral rewards.

• Milestone rewards: Shards awarded for reaching cumulative active referral thresholds (1, 3, 5, 10, 25, 50, 100). Each milestone claimable once only.
• Monthly leaderboard rewards: Each calendar month, users are ranked by new active referrals. Prizes are disclosed on the referral dashboard.
• Self-referrals, multi-accounting, and any artificial inflation of referral counts are prohibited and constitute fraud. Accounts found to be abusing the referral program will be permanently banned and forfeit all rewards.

7.3 General Reward Conditions

• All in-game rewards are final and non-exchangeable
• We reserve the right to substitute a reward of equal or greater value if a specific item becomes unavailable
• Rewards have no cash value and cannot be converted to currency

8. Prohibited Conduct

You agree NOT to:

• Violate any applicable law or regulation
• Use bots, scripts, or automation tools against the Service
• Exploit bugs or vulnerabilities
• Harass, threaten, or abuse other users
• Attempt to gain unauthorized access to our systems
• Share, sell, or transfer your account
• Engage in chargeback abuse or fraudulent payment activity
• Interfere with the normal operation of the Service

9. Responsible Play

• The Service is intended as entertainment. Do not spend more than you can afford
• Self-exclusion and account closure tools are available from your account settings
• We do not target dark-pattern checkout flows, pre-selected upsells, or deceptive cancellation paths
• If you have concerns about your gaming habits, contact a qualified support organization in your jurisdiction

10. Intellectual Property

All content, trademarks, and intellectual property on FragDraft are owned by us or our licensors. You may not copy, reproduce, or distribute any content without permission.

CS2, Counter-Strike and Steam are trademarks of Valve Corporation. FragDraft is not affiliated with or endorsed by Valve Corporation.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Uninterrupted or error-free operation
• Accuracy of player stats or tournament data
• Availability of specific cosmetic items or reward tiers
• Compatibility with all devices or browsers

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAGDRAFT SHALL NOT BE LIABLE FOR:

• Loss of data, profits, or in-game progress
• Service interruptions or technical issues
• Unauthorized access to your account
• Third-party conduct or content

13. Dispute Resolution

These Terms are governed by the laws of Austria. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Austria. Nothing in these Terms limits consumer rights that cannot be waived under applicable mandatory law in your country of residence.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes affecting paid SKUs will be notified by email at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
